Terms of Service

These Terms of Service ("Terms") govern your use of QOSYN (the "Service"), operated by QALSER Inc.("we", "us", or "our"), available at qosyn.com. By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

QOSYN is an AI-powered social media content creation, scheduling, and publishing platform. The Service allows you to generate content using artificial intelligence, schedule posts, and publish directly to connected social media accounts across the following platforms:

  • Facebook
  • Instagram
  • Threads
  • LinkedIn
  • Twitter/X
  • TikTok
  • Pinterest
  • YouTube
  • Bluesky

2. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to use the Service.

3. Platform Compliance

By connecting third-party social media accounts, you agree to comply with each platform's individual terms of service, community guidelines, and developer policies, including but not limited to:

  • Meta Platform Terms (Facebook, Instagram, Threads)
  • LinkedIn User Agreement and API Terms of Use
  • Twitter/X Terms of Service and Developer Agreement
  • TikTok Terms of Service and Developer Terms
  • Pinterest Terms of Service and Developer Terms
  • YouTube Terms of Service and API Services Terms
  • Bluesky Terms of Service

You are solely responsible for ensuring your content and use of the Service complies with all applicable platform policies. QOSYN is not responsible for actions taken by third-party platforms against your accounts.

4. AI-Generated Content

The Service uses artificial intelligence (including OpenAI GPT-4o and Anthropic Claude) to generate content. AI-generated content is provided as-is and may contain inaccuracies, errors, or content that does not meet your expectations.

You are solely responsible for reviewing, editing, and approving all content before publishing. We do not guarantee the accuracy, appropriateness, or legality of AI-generated content. You should not rely on AI-generated content without independent verification.

5. Content Ownership

You retain ownership of all content you create, upload, or generate through the Service. By using the Service, you grant QALSER Inc. a non-exclusive, worldwide, royalty-free license to process, store, and publish your content solely for the purpose of providing the Service (e.g., scheduling and posting to your connected accounts).

This license terminates when you delete your content or account, except for content already published to third-party platforms, which is governed by those platforms' respective terms.

6. Acceptable Use

You agree not to use the Service to:

  • Generate or publish spam, misleading, or deceptive content
  • Create or distribute hate speech, harassment, threats, or content promoting violence
  • Violate any applicable law, regulation, or third-party rights
  • Infringe intellectual property rights of others
  • Attempt to circumvent platform rate limits, API restrictions, or security measures
  • Use automated or bulk publishing in violation of platform policies
  • Impersonate others or misrepresent your identity

7. Subscription & Billing

The Service offers subscription tiers with varying features and limits. Payments are processed securely through Stripe. By subscribing, you agree to pay the applicable fees and authorize recurring charges. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to modify pricing with reasonable notice. Price changes will not apply to the current billing period.

8. Account Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to the Service or other users. Upon termination:

  • Your access to the Service will cease immediately
  • Your data will be handled in accordance with our Data Deletion Policy
  • Content already published to third-party platforms will remain on those platforms unless you remove it directly

You may delete your account at any time through your account settings or by contacting us.

9. Limitation of Liability

To the maximum extent permitted by law, QALSER Inc. shall not be liable for:

  • Changes to third-party platform APIs, policies, or availability that affect the Service
  • Content removed, restricted, or flagged by third-party platforms
  • Loss of data due to third-party service outages
  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Inaccuracies in AI-generated content

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
